UPDATE: Gov't to Appeal Raia Jail Sentence and Fine



UPDATE: Sorry peeps, I got that backwards. The U. S. Attorney is appealing Frank's sentence. Oomph.

2019 exited without any new federal indictments, informations or complaints charging Hoboken vote-by-mail bribery.  So then, what is the status of those who've already been swept up in the U.S Attorney's web, either with a guilty plea: Lizaida Camis, Dio Braxton, Matt Calicchio, William Rojas, or  a trial and conviction:  Frank Raia?

Here we go, plus breaking news...

GOV'T TO APPEAL SENTENCE 
Last THURSDAY, the U. S. Attorney's Office filed a Notice of Appeal to the U.S. District Court, informing them that they will be appealing the Court's judgment of sentence.  As stated in NJ Court Rules: 

Rule 2:5-1. Notice of Appeal:
"An appeal from the final judgment of a court is taken by serving a copy of a notice of appeal and the request for transcript upon all other parties who have appeared in the action and, in adult criminal matters, upon the Appellate Section of the New Jersey Division of Criminal Justice, and by filing the originals with the appellate court and a copy of the notice of appeal and the transcript request with the court from which the appeal is taken..." 

What does this mean for Raia? The clock has stopped on executing the court's final judgment pending the outcome of the Appeal.

DIO BRAXTON 
Dio Braxton's sentencing date, re-scheduled for December 2, 2019, was adjourned on December 2 as follows: "new date to be determined." 


LIZAIDA CAMIS
Lizaida Camis' scheduled sentencing date, November 7, 2019, was adjourned on October 16, 2019 as follows: "new date to be determined." 


MATT CALICCHIO
Matt Calicchio's scheduled sentencing date, November 7, 2019, was adjourned on October 16, 2019 as follows: "new date to be determined." 


WILLIAM ROJAS
Rojas plead guilty on October 8, 2019.  Sentencing set for February 20, 2020.

  1. I would highly doubt that this delay action will change the outcome but it will cost Raia a good deal more in legal bills.

  2. Raia doing time and being sentenced for his crimes is appropriate, but are the feds going to do nothing about the candidate(s) his actions helped, and who knowingly benefited from the scheme?

    Now that the current election is over, they can sweep in and clean house at city hall, and not be accused of affecting the outcome of an election.

    We need to pressure our assemblymen to change the garbage legislation that gave us VBM in the first place. VBMs are too easily exploited by those who could never win a clean, simple majority vote, which is to say most of our city council.
