On September 19, 2019 the Court entered a postponement for Frank Raia's sentencing issued, as follows:
"The Court is in receipt of Defendants motion for a new trial and brief in support, ECF Nos. 54, 57, and the Governments opposition thereto, ECF No. 60. In light of the time remaining for Defendant to submit his reply brief and time required for the Court to carefully consider the submissions, the October 3, 2019 sentencing will be POSTPONED. On September 27, the Court granted Raia's attorney a 2-week extension on filing his reply brief (to the Government's opposition.
So when will the Judge decide on Defendant Raia's request for a new trial?
Four days ago (October 7) the Court announced a schedule for a hearing (oral argument) on the Defendant's motion:
"NOTICE OF HEARING ON MOTION in case as to FRANCIS RAIA MOTION for New Trial: Motion set for 10/21/2019 01:00 PM before Judge William J. Martini. "
It is at the Judge's discretion whether to decide on the motion at October 21st hearing or later. Stay tuned.
