TOMORROW: Oral Argument for Hoboken BoE v NJDoE/HoLa TRUSTEES


No blizzard in the forecast, so this hearing which has been rescheduled several times should happen at 10:00 AM tomorrow.

Be advised, long lines at the security check  to enter the building so folks who plan to attend tomorrow should arrive early.

  1. This is a pretty big deal not only for Hoboken, but for other racially and economically diverse communities in NJ. Not whether Hola's expanded grades should be closed (no one is asking for this by now), but rather what steps the Department of Education needs to take regarding diversity when allowing public funding for new / expansion of charter schools. The argument the BOE is making is that they - the DOE - did not do enough.

  2. Sounds like the AD will probably dismiss the case as moot, if its true that the district has formally in writing, advised the Court that it is withdrawing in full its request for relief. The job of the courts is to decide controversies that are actually before them not to make broad proclamations on public policy, or hold oral arguments for the purpose of facilitating public debate, no matter how important the parties might think the debate is.

    If the renewal and expansion of HoLa's charter is really, in a complete legal sense, no longer being challenged then this ought to be an extremely short hearing.

    Are you sure the District isn't still asking for a remand back to the State with court mandated guidelines that the district hopes will ultimately result in a denial of the expansion? That would make more sense. Otherwise, this all seems like a waste of time.

    1. The district has not withdrawn or amended the papers being adjudicated tomorrow.

  3. Actually, even after it was moot (meaning the election that involved the referendum had already occurred over a year earlier) Tumpson V. Farina II went all the way up to the State Supreme Court. The situation that occurred with that case was important for and will have an impact on the citizens' right to referendum in the future. It also provided much needed guidance to municipalities. I would think that would be similar to the Hola case.

    I would think that the courts might see the value in rendering a decision in the Hola case for the same reason.

  5. Nothing agains HoLa parents or children...

    But I wouldn't trust Frank Raia and I would scrutinize anything he is involved with. Just my personal feelings.
