Liebler Demand: $150K from City with 90-day apology

GA's OPINION: Liebler v Hoboken City, Mayor Zimmer, et. al is a taxpayer-subsidized email witch hunt to nail "Stawn"

Once upon a time, local political activist David Liebler OPRAed Hoboken City's legal expenses for years 2008-2011, did his own year-by-year analysis on spreadsheets, and his uncontested findings were reported city-wide on the cover of the print edition on the Hoboken Reporter.

That was then.

Liebler's PR campaign against the city's legal expenditures included appearances at Hoboken City Council.

Thus, Liebler fashioned a public personna as a fiscal watchdog for the Hoboken taxpayer;  the city's legal expenditures are undoubtedly a matter of public interest and public concern.

Hence, there is no doubt that any court would find Liebler is a public figure for his commentary on matters of the City's legal expenditures.

But, after his successful foray as a fiscal watchdog, his public personna took a loud, partisan turn.

Liebler has waged a public war as a strident critic of Mayor Zimmer with political cartoons, online commentary, and appearances at public meetings where he has demonstrated disorderly, disruptive behavior- including refusing the orders of the Chairperson/President of the governing board at the HHA and the City Council (the subject of his lawsuit).

GA's observation of  Liebler's public commentary over the years, is that he has morphed from the public posture of Hoboken fiscal watchdog to partisan  attack dog.

One has to simply look at his output of political cartoons, as a catalog of his years-long obsession with Stan Grossbard, husband of Mayor Zimmer.   Liebler's cartoons and internet postings express his belief that Stan is running the Mayor's office; I believe he authored the nickname "Stawn."  

Sure, Liebler's cartoons are fair comment, and protected free speech.

But in GA's view, his cartoons and writings convey a personal hatred,  malice toward "Stawn" and no longer advocate for or against public policy or fiscal responsibility.  Liebler seems obsessed with unmasking Mayor Zimmer as a fraud with her unelected husband pulling the strings.  (Every professional woman out there 'gets' how offensive that is)   Liebler's satire goes beyond her role in government, it burrows into her resume to mock her work as a photographer, suggesting she is a blank slate- a nothing.

His internet postings say it all: Liebler angrily calls Grossbard  "blood diamond boy," an anti-Semitic reference to Jewish diamond dealers, and "bitch."


It is not rocket science, people.

Anyone can draw a straight line from Liebler's satirical conclusions that "Stawn" exists to seeking proof that "Stawn" exists via David Liebler v City of Hoboken.  

Liebler's lawsuit is an email witch hunt and a money-grab.  The fiscal watchdog of yesteryear is a memory. That is my OPINION.

This is a fraction of the public domain evidence of Liebler's "Stawn" obsession; his satirical conclusions that Stan Grossbard ("blood diamond boy") is running Hoboken.


I am no lawyer, but I played one for 17 months. Though Stan is a public figure, defamation law says that Liebler is not allowed to make shit up.   In my layperson's opinion, the trail Liebler has left in cyberspace would meet the "actual malice" standard of defamation of a public figure.
   
As a Hoboken taxpayer, I urge the City not to cave to a single demand and FIGHT this to the end. If the City does not, you might as well put a revolving door on City Hall's Legal Department. 

Hoboken: do NOT give Liebler ONE PENNY.

One last thing, Liebler's oft-repeated allegation that the Mayor "employs" websites is false, and an effort to discredit my political discourse. my First Amendment protected speech..

  2. Hoboken political operative David Liebler, if I recall also bragged that he was paid to run Frank Raia's mayoral campaign and yet he turned on his old paymaster in those nasty political cartoons he produced and disseminated. Says a lot about the man.

Calling someone a political operative, even though they are a political operative, is the basis for a SLAPP suit disguised as a defamation claim whereby a suicidal, smarmy, brain dead, self destructive, ego maniacal moron, vertically challenged, 5th floor walk up residing, buy his clothes in the boys department of JC Penney, Cousin It look a like in his ground scrapping rain coat dragging his milk crate on rollers of boomerang emails, backed by a lonely pathetic and rich harridan whereby the idiot (and poorly advised) plaintiff will lay claim to 2 million of your hard earned dollars (or your condo - your choice). But the good news is that I hear Jay Zeke is available for consultation in such slimy and messy situations, but you have to have a credit card handy, preferably one with a very large limit. And it doesn't have to be issued in your name. Or it can be one of those prepaid thingys. I wonder if Jay Zeke can get you as good a deal as the anonymous defendants got? Or maybe that out of state Whitney guy can be of assistance.

    4. 6:42- that is not exactly how it went down. Liebler was disorderly, yelling, refused to listen to Council President Bhalla. The police are there to assist with disorderly members of the public and to stop disorderly conduct from escalating. You may say in hindsight that Bhalla overreacted, and that's your opinion. But, once members of the public become disorderly, how would Bhalla know that this member of the public wouldnt turn violent? Of course, Bhalla was within his right to have Liebler removed. That Liebler is suing Hoboken for this (check out his Grossbard witch hunt discovery requests), that taxpayers have to shell out a single penny on this, is grotesque.

      And, since you called me out- from my perspective as a person whose actual free speech rights were attacked with 5-year SLAPP suit, a person engaged in an real First Amendment battle against political operatives, that a political operative like Liebler, wants to make a buck off MY back on a frivolous First Amendment claim, is deeply offensive.

      Do you believe this merits a lawsuit? Are you a Hoboken taxpayer?

  4. Liebler is a no talent buffoon who can't come up with any ideas on his own. The cartoons weren't done by Liebler. They were done by a buddy of his who is a professional cartoonist. And calling Dawn and Stan "stawn" probably came from Sara Stojkavic. She uses it all through the Bajardi emails. The fantasy that Stan is the real mayor probably came from her too. It's pretty amazing how much insanity has flowed from Sara's insane jealousy of Dawn's success. Liebler is nothing but an empty headed idiot carrying Sara's water. Maybe we should start calling them "Dara" or "Savid".

    1. You're right about the "Stawn" references in the Bajardi emails. I can check how far back they go.

      The toons actually were a collaberation- Lieber was the 'idea man'- he "wrote" them, his artist friend Martin Kozlowski drew them. Hoboken411, ran them in a feature, "Hoboken Toons", and Liebler published them on Facebook, Pinterest and...? Let's see if he tries to delete the tracks he's left in cyberspace. I believe that's called spoliation of evidence, can be interpreted as guilt.

    2. It's like anything else, snoopy. Meaning changes with context. It's a word I use that has various meanings (i.e.; what a person who is rightfully imprisoned may become by their cell mate), others may not. To each his/her own.

    Anybody got a problem when cops remove a disorderly member of the public at a council meeting? Should Council members roll a dice to see if a member of the public gets hurt, or restore calm, order and public safety? Not a difficult choice. I saw the video clip from the meeting. Personally, I found Dave L's and Perry B.'s behavior menacing.

  7. Lieber got tossed from the meeting for being disorderly, it had nothing to do with Stan. He's now trying to spin it into a Stan/email thing, but those had nothing to do with why he was thrown out. He was thrown out of the meeting because he was disorderly, period. There's no case here.

    1. The Bajardis had no case either. Look what happened to them. Their house is going on the auction block. Likewise, the city should go for fees and sanctions and Liebler should pay back taxpayers every single penny we spent on defending this garbage.

    3. Seizing real property is a last resort. Bank accounts then chattal before real property. In the case of a bankruptcy claim, the court becomes Trustee of assets to pay off the debt.

    4. His paycheck can be garnished. They really should file a counter suit and demand legal expenses be paid by the ass. I swear, if a couple more of these frivolous suits get turned about on the jerk filing the suit - that would put an end to this nonsense.
