Wow.
Is the irony of a First Amendment lawsuit by a rabid anti-Zimmer activist who routinely attacked the political speech of anonymous internet commenters and blog proprietors lost on anyone?
David Liebler, who attacks authors of political discourse he dislikes and has for years, even threatening anonymous screen names that he (and unidentified others) have created a "list" of their presumed identities:
"Ojo, I can not wait till I find out who you really are....we have a pretty complete list of everyone who blogs under fake names, looking forward to getting yours!"Really? GA looks forward to the discovery request for the "list" and the identities of parties involved in making this "list."

In an earlier Patch post, on April 25, 2013, Liebler admits his motive for the "list"- to strip screen name commenters of their anonymity and expose them in the public square, because (he calls) their political speech "disgusting" and "horrible:"

Here Liebler satirizes Reform faction bloggers, turning us into "Zimmer zombies" because he doesn't like what we say. So what? It's kind of funny. Satire v satire. You don't see GA running to court with a box of Kleenex, or crying he's "horrible" and 'disgusting!" Waaaaaaaa.

Liebler, a hard-core critic of the Mayor, has used the services of a professional cartoonist to satirize "Stawn" (a pejorative name he created) on Hoboken411.com and Facebook for years. In GA's OPINION, this unrelenting public campaign establishes Liebler as a limited public figure with an agenda. "First Amendment" my butt-- this lawsuit is about politics. This is about Liebler's very personal vendetta ("how does it feel now, bitch!"), not First Amendment principles. Liebler's got a PR firm who sent a press release to PolitickerNJ announcing the lawsuit before it was served to Defendants. Do most Plaintiffs enlist the services of a PR firm before they serve their complaint? He is using the services of the Mile Square Tax Association attorney, not a 'First Amendment' lawyer. Enough said? In my OPINION.

Courts are NOT political battlefields for Hoboken operatives or rabid opponents of one political faction to attack the other, and for Hoboken TAXPAYERS to underwrite,
It sure is light years from December 2011, when Liebler's personal audit of the City's litigation expenses obtained via OPRA generated media coverage. Liebler's position was that the City's expenditures on litigation were "out of control."
"Resident David Liebler, who has worked for an anti-Zimmer candidate in the past, filed an Open Public Records (OPRA) request recently asking for all of the legal expenses for the city of Hoboken since 2008.
“All I heard was legal, legal, legal at every council meeting,” Liebler said last week. He said it took him a month to review the thousands of documents that he received.
Then he organized a spreadsheet with the costs, which he certified as correct by the city’s Legal Department. Liebler provided the documents to the Reporter.
“What I found was astonishing,” he said. “The spending is out of control.”
Yes, it is.
And, in my OPINION, David Liebler's lawsuit is a cynical political operation we all have to pay for.

Well I would think its a safe guess that this "list" that he and other dark siders were compiling was largely fed by 411, as the emails have shown us. I also am of the opinion that they were always guessing as to the unknown ones as well, as the emails have shown us.
ReplyDeleteI am also of the opinion that most of the John Does thrown in to the suit were just added in the hopes that they could be identified. The comments some of those made that were referenced in the SLAPP suit were so benign that they did not rise to the level of damages. In my opinion the dark siders wanted to harass and embarass those people potentially if they could.

Are you saying there was coordination on filling the blanks on this list with the SLAPP operatives? Liebler's email with James Barracato and should be subpoenaed.
DeleteI'm saying that based on the emails we have seen from the SLAPP suit that it is my opinion there seems to be coordination and the fact that Liebler says "we have a pretty complete list".

ReplyDeleteI think Gormally might be already be experiencing the same kind of buyer's remorse Lane Bajardi's lawyers eventually felt. I expect Liebler forgot to to Mr. Gormally about his history of defaming the Mayor's husband with blood diamond references. I wonder how many references to blood diamonds are made in his emails with Sara Stojkovic? I guess we'll find out in discovery unless Mr. Liebler is lucky enough to have his case dismissed first.
ReplyDeleteCompensatory damages huh? Suing Defendants "privately" and "in their official capacity" for....? Not letting a political operative turn a council meeting into circus? HCV called Liebler a "long time political operative" correctly so. Liebler pulled a Lane Bajardi only in federal court. Federal court is a very interesting choice for a NJ First Amendment case.

ReplyDeleteThat may be a possible strategy in their minds but I doubt it is a probable outcome. In the past this sort stupidity has only resulted in galvanizing the Hoboken's reformers resolve.
Delete@snoopy, agree. Jake and Dana didn't get a dime for their troubles trying to root out an exceptionally bad actor who was screwing over the very people who most loudly defended him. Both got sued. Whether their attorney's fees are paid or not, it's not an experience you would wish on anyone.

These folks prevailed in the end. But it's hard to believe all this ugliness doesn't have a chilling effect. Are we losing some of the people who could really benefit the city on boards or in elected office? Are they thinking twice about whether they want to deal with the lawsuits and smears which can only be thought of as not merely possible but inevitable at this point? Not to mention the strain on their families, children, and friends as their names are dragged through the mud in the name of morally bankrupt but always well-financed political forces. Not to mention becoming "googleable" to current and future employers whose natural reaction would be "why would anyone make up a story like that?"
So sad but so true, Dang. I really respect people like the mayor, Dana and our city council reformers for putting it all on the line with the risks and hassles that come with the territory when opposing the dark side. Luckily voters have been seeing thru the OG BS.

Dave Liebler is a lying sack of crap. When I ran the Hoboken Journal I was never once compensated by Dawn, Stan or anyone else on reform for writing my opinion blog. I never once knowingly wrote something that I knew was false unlike crap for brains Lielbeler who has consistently try to defame anyone who does not lie in bed with developers.

DeleteHoboken is like a brownfields site. You'd think the results of the last election would inspire the old guard to see the writing on the wall. But no, they still pursue their hopeless dreams. This isn't a referendum on Dawn Zimmer. It's a referendum that states that the people of Hoboken are no longer going to tolerate the corruption, illegalities, cronyisms and dirty campaigning of the past, no matter who the mayor is or isn't. If the old guard doesn't change its tactics it is doomed to the political graveyard.
