Folks, I understand that Hoboken City Council members sometimes send and receive electronic communications during council meetings. There are no rules against it. But...
What about a Councilperson taunting a member of the public who is present in the Council chamber?
Last Wednesday night, Councilman DeFusco sent this message to Karen Nason during a presentation of the Southwest Traffic Study:
"There were women present [at his LGBTQ fundraiser], both gay and straight, but as a mayoral candidate I didn't notice you there."Nason did not provoke this communication nor respond to it.
While GA may find such unprovoked behavior 'wrong', the conduct may have violated Hoboken's "Executive Order to Ban Workplace Violence, Harassment and Incivility", signed by Mayor Zimmer on February 10 2011.
Defining "misconduct" includes written communications which "may be offensive to another."
The only reason GA knows about this is because Councilman DeFusco's text was "offensive to another"- Ms. Nason.
To say that DeFusco's text upset Nason is an understatement.
Specifically, the implication that she was not supportive of the LGBTQ community because she didn't attend his LGBTQ fundraiser. Here's why, in her own words.

"Mike, while I am sitting there last night sends me a text to my phone "There were woman present,both gay and straight, but as a mayoral candidate I didn't notice you there" Seriously? First Nancy he never invited me and it was up then it was down then back up... who the hell knew. Like I am going to answer him... by the way my brother Scott is gay and came out years and years ago. I stood up for him at his wedding in Hawaii, I stood up for him in Boston where he was living. My brother has been married for 32 years to the same man my brother-in-law Mickey, and Scott would eat Mike up for breakfast. He cant stand when men like Mike use the gay card!! I will try to get my brother here from Florida to first fundraiser. He is really pissed that Mike sent me this text as he, more than anyone knows how many events I did in concert for Gay rights. I dealt a lifetime of having five brother's growing up in Maine and having four of them straight all of us popular and as a cheerleader used to defend my Gay brother with all the [expletives] who gave Scott shit. Scott would love to talk to Mike about how much men like Scott hate when guys like him pull that gay card bullshit. I am 53 years old and Scott 55. I fought more for their rights than anyone and this was in a time where this was really fucked up. How dare he challenge me on that one. How dare he. Nancy these guys around Mike have people call me to "drop out and let him run" all the time."

GA can synopsize: Nason's had a lifetime of protecting her gay brother-who was bullied as a kid, grew up and couldn't marry the love of his life, and throughout the years, the loving sister supported her brother's fight for civil rights and the rights of the LGBTQ community.
No, DeFusco's text did not sit well with her.
It struck a profoundly deep and personal nerve. I would call it, by definition of the 2011 Executive Order "workplace misconduct."
GA's observation: the alleged pressure to "drop out and let him run" (of the mayoral race) is having the opposite effect on her.
That little turd droplet needs to fade away. It appears that he was still in diapers when she was a champion of gay rights. Vile asshole. Who cares that he is gay? This is Hoboken in 2017. I don't give a fuck who occupies his bed. What the educated residents in town want is COMEPTENCE, not juvenile petulance, in government. How about that tax decrease by the City this year? WTF has this little weasel ever done that would give anyone comfort that he is up to the task of being mayor? I will give Mr. Turd kudos for getting rid of the First Ward witch, but that appears to be the sum of his contributions to the City Council to date. GA how do we move forward to file a complaint against Defusco? Do we need to set up a gofundme page for legal? His comment really bothers me as well, and would like to see legal action taken as a tax payer of the city of Hoboken and a supporter of gay rights.

This could mean some real savings ($.00) for you as the person who will be listed as the plaintiff up til the counter-suit.

Well, that did not take long for the merry band of DF trolls to pop up and offer up the silly notion of moral equivalency to defend the noxious text. Let's forget for the moment that MD was too busy insulting Nason when his attention should have been on CC business. If memory serves correct from watching the meeting, the time in question was during a transportation presentation. Instead, he had to petulantly send a moronic text message. Whatever Nason said, she said it out loud and proud and took the deserved heat for it. I think her comment was dumb and offensive. And it did affect my opinion of her. But this is Mike's issue, not hers, and there is no need for the faux moral equivalency outrage you profess in this discussion. Let's see if MD can take the heat he deserves or needs to leave the kitchen.

Nason apologized. Will Mike? She also inferred she'd been mislead to believe so most likely from one of her so-called OG friends who keep calling her and telling her to drop out and clear the field. DeleteI haven't called Nason and I wouldn't have any reason to. Her Mayoral bid is fine with me. The more the merrier I always say and I certainly haven't anointed DeFusco to anything. As far as DeFusco announcing, I have no barometer on that. The election is in November and I don't think petitions are due until August or September. Doesn't seem all that late to me. When last I looked it was April.
What does seem to be lagging to me is an announcement of Mayor's slate. Why don't we know who is running with her? Is she planning something strategic, like waiting until other slates are announced and then tossing someone overboard? IfI attend her upcoming fundraiser, I want to know what her whole slate looks like before contributing and that fundraiser is just around the corner. It's getting late, isn't it?
Anonymous at 4:59 - I'm afraid I'm not as controlling and dogmatic as you are. If a council member sends a quick text or goes to the restroom, or leans over to ask another council member a question during a presentation, I don't think it's a felony. The camera is on DeFusco during most of every council meeting; he seems pretty attentive to the citizenry to me.

If an elected official is texting during the a public meeting to a member of the public, it is NOT a "private" text. Nor was it personal. Councilpersons text messages CAN be OPRAed.

3:05- a couple of things. I am not an advocate for Karen's election, I am an advocate for her RIGHT to run. That's it. The stuff about FUSE is all part of the public record. Its fair comment in your campaign against her. Have at it. One difference btwn Nason and DeFusco is that she announced first, and has to put together a campaign. Conversely, DeFusco has been campaigning for months but no announcement. In that way, he has opened himself up to scrutiny and criticism. Karen has filed her campaign, DeFusco has not. Hard to take anyone who hasn't held a full-time job or a municipal position of any kind, seriously. Karen's husband was a good zoning board member who can teach her a few things about municipal zoning, but he was not reappointed and it's public record to show her disdain for the Council's refusal to reappoint him. Nobody is accusing Karen of breaking the law, she actually broke it (facts are funny things) and the letter from City Hall alerting her of these violations was published and readily OPRA-able. It's unfortunate that you turn your head when doing a bio on Karen and ignore these pretty important facts, yet attack DeFusco for breathing.

Yes, the message was directed BY Mile to Nason. But Nason “started it” with the Giattino comment, as heard from the kiddie table. From what I remember, Nason apologized for her attack on Giattino. I have yet to hear one thing from the minions or Mike himself as to what his actual “platform” is and why anyone should vote FOR him, other than just throwing random shade. A person who may be reporting Hoboken news on the radio and influencing Hoboken public opinion by posting anonymously is just NOT the same, not comparable with private citizens expressing their opinions.
Right- you are right about the chilling effect on First Amendment protected online speech due to the filing Bajardi v Pincus. Most people prefer to post as Anonymous because of the chilling effect of that SLAPP suit.

Nason has slammed zimmer, accused her of getting money from Suez Water , accused Giattino of calling her names and had " proof on tape" and is closely tied to Anthony Romano-- she's criticized Zimmer in 1 month more than anyone, yet she's encouraged by this blog?

IMHO Since only Zimmer and Nason are in the race , I'm not sure why so much is being exhausted on DeFusco?
As for the other made up battle between Sacco and Stack- nice try
They're on the same HCDO leadership team, they run Hudson County and they are BOTH endorsing Zimmer.
They both endorse Romano.
I'm hoping for a fresh option, but so far I don't see anyone worth fighting for or fighting over
Zimmer has had 10 years in government

Why is he so bad, he runs a county high school that most people kill to get their kids into especially the politically connected who he ensures don't get to jump the lines

Nason running for Mayor reminds me of the scene in the movie Monster where Scarlett Johanson goes in to a lawyers office to work as a paralegal. Her potential boss tells her she has no experience, no history and that you just don't end the party at Daytona Beach and decide to become a paralegal, in this case, Mayor. She is not pulling votes from anyone, only people as delusional as her will vote for her which amounts to 4 votes, her husband and undocumented workers in her pizza kitchen. Her ship has sank before the christening. She is irrelevant, almost as irrelevant as this blog, read by 14 people each with 28 user names. Zimmer is going back to New Hampshire in a canoe and no paddle this November.

DeleteAs for comparative resumes, other than a single not terribly notable year on the City Council, what exactly is it about Mr. DeFusco's professional career that would make him more qualified than Karen?
Indeed, Mike is by any standard by far the City Council member least qualified to step up to job of Mayor, and the bumbling nature of his campaign so far doesn't exactly enhance his thin resume.
Even his rumored ticketmates are more qualified to serve as mayor than Mr.DeFusco, and that's not exactly a high bar.
And the entire media said trump would lose... Yawn

DeleteIt's telling that not only have his supporters been unable to articulate a single coherent reason why anyone should vote for DeFusco over Zimmer, they can't even articulate a reason to vote for him over Nason. That's why they"re resorting to lobbing personal attacks and threats at her, a tactic that is backfiring badly since lot's of people like Karen as a person even if they disagree politically, and pretty much no one likes Mike's nasty surrogate/ticketmate, whose legendary venality rivals the worst of the Mason team.

DF is not going to make it terribly far in politics, unless he takes on a wise political mentor. Too many amateurish mistakes already. Nason seems honest and open. DF, not so much.
