Just in and fresh off the Q-Tip, an Ear witnessed the following....

A motion filed on behalf of so-called 'ethnic cleansing' Defendants will be heard this Friday in Hudson County Superior Court.

What's it about?

GA's Q-Tipster says the motion concerns approximately 1,000 emails recovered from an HHA server. 

The Q-Tipster alleges the 1,000 emails are between Carmelo Garcia and his attorney Louis Zayas, some include third parties. According to the Q-Tipster, Garcia used public email servers (belonging to the HHA) to correspond with his personal attorney, Zayas.  GA's Q-Tipster said though Garcia had deleted all email files off his hard drive before leaving, all of them were recovered off the HHA servers.

GA asked the Q-Tipster about the pending motion.

There wasn't much wax available.  The issue before the court is whether any of these emails, conveyed on public servers, are protected by attorney client privilege.

GA imagines the ones containing third parties (non-parties to the litigation) are not protected, meaning they can be used in the litigation, and are OPRA-able.  What about the rest of the 1,000 emails between Garcia and Zayas?

Why didn't Zayas tell his client not to communicate with him from a federal email address?  Garcia's attorney should have known that.  Even SLAPP Plaintiff Kim Cardinal Bajardi knew how to circumvent the public eye:


So, if these Garcia-Zayas emails are introduced, it is possible they could blow Garcia vs. Zimmer et. al. wide open.

  2. If Carmelo was using his HHA email address with Zayas, then he probably was with Ruben, Campos, Liebler, Eduardo, Belfiore and so on. Those are public documents.

    - any mentions of Jessica Coco.
    - any instructions to allegedly "independent" board members before meetings.
    - any references to Beth Mason.
    - any pre-planning of "spontaneous" demonstrations.
    - any coordination with Patty Waiters who was paid by taxpayers as an assembly aid, not an HHA attack dog.
    - any email with finboy.
    - any bad mouthing of Brian Stack, Dawn Zimmer, Joe Branco (for yuks)
    - any perk-seeking, all those out of town seminars for which no report of findings or value was ever provided.
    - all communication with Ruben Ramos.
    - Boolean searches on absentees, vbms, Frank Raia, 4-4, 4-2, Angel Alicea, Anthony Romano, etc.

    How hilarious would it be if this alleged MIS degree holder (and friends) was done in by not understanding the difference between the email on his machine and the email on the server.

    Did these morons not learn ANYTHING from the Bajardi fiasco? 50k emails. 50k. Which GA and Horsey have used effectively to drive, not only the Bajardis, but the OG as well, nuts. And as they have both said, the emails that have been published are just the tip of the iceberg. Didn't Liebler understand that he was at risk because of those emails? Wasn't he in fact copied on some of them that were published? I wonder what else GA has on him that she has not let loose. Mister Carmelo is about to get hoisted on his own petard. I wonder how many of his frenemies are freaking out about all of their dirty tricks being exposed by Mr Carmelo. I wonder how Mr. Zayas is feeling right about now. Maybe it is a good time to bail on this loser, before he gets hit with Bajardiesque sanctions himself.

    1. Louie Zayas may be able to get his money from Weehawken and get outta Dodge but it doesn't look for him here. Not at all.

      Can you say frivolous lawsuit and sanctions? Think the victims of Carmelo's ethnic lawsuit can get legal fees and more from the the property listed at 711 Bloomfield St?

  5. May be why Unger and Matzner backed off the Carmelo emails story. Its obvious there had to be a lot more emails only defendants weren't leaking. Question is how much email did Carmelo send from his hha account?

  6. The Bajardis emails were tied to litigation and privileged. They only entered the public domain through legal channels. On the other hand most of Carmelo's correspondence on HHA servers has zero legal protection. If he discussed Beth paying for the slapp or dispatching Waitters to a city council meeting to promote Vision 20/20, that is open to the public NOW.

  7. Sounds like an OPRA fest waiting to happen. Anybody can file an OPRA request. I wonder if anybody will. After all, Beth Mason doesn't hold an exclusive on public document requests.

      Then after that decision we'll know.

  8. IMO there's no expectation of privacy when emailing from the office, using the office servers, and that goes double when your office is a federal agency. I don't see how the court will grant privilege to these 1,000 emails but you never know.

  10. You know what else is OPRA-able? texts or emails, sent or received while on the other side of the piece of "magic wood" as one failed mayor called it, referring to the council dais. Meetings are recorded, time and date-stamped, making such a search much easier. If emails themselves don't flesh out the whole tale, one could always roll the tape and see just who was receiving or sending. Everything from "let's order in tonight" to "let's sue everyone in Christendom". Bet they didn't know that.

    1. Not true unless you adopt Beth Mason's imaginary view of OPRA. Only government records are OPRAable and the fact that a communication occurs at a Council meeting doesn't make it a government record. If it's between CC members as part of a deliberation of an issue being discussed at the meeting it certainly would be a government record as well as an OPMA violation. Anything else would depend on what was said and who the parties were.

      Also, even if something is technically OPRAable, if its not in the government agency's possession they have no way of providing it unless the person who has it in personal e-mail, phone etc., voluntarily agrees to provide it. So even if it's technically a government record, thinking Beth Mason or Mike Russo is likely to give it up is serious wishful thinking.

I'd happily contribute to a fund so that these, and the 50,000 previously released emails, could be scanned and uploaded in searchable format to the internet so that we can all see the scum we're surrounded with, their machinations to destroy Hoboken and proof that they should never be trusted. Their toxic tentacles are far-reaching and any citizen who either dared run for office or did something as benign as held a bake sale for their kids school has probably been in their cross-hairs. By revealing all the players, they will hopefully be shunned enough to leave town.

      They are public documents so anyone can get them from the court.

  12. Hi, I'm Carmelo's old keyboard from the HHA. Didn't see much activity from him after August last year. But damn if Carmelo didn't show up and beat the living crap out of my delete key late in the month. It was so sore. Got pounded so much, I needed stitches.

    No joke, he really rammed it hard on my delete key. Then some nice people came and after a few less than clumsy strokes brought about a nice recovery.

    All better now except the thousand emails are actually a lot more than that from what used to be on my hard drive. You should see the crap Carmelo and Zayas were talking about.

    Ok well, see ya soon. I have to update some Excel files for inventory.
