Imagine you have to defend yourself against a $2,000,000 civil complaint, and discovery documents you requested on November 20, 2013 arrive 223 days later, on July 1, 2014.
Imagine how long it might take you to review 49,081 email documents (many are multiple pages), you received on May 16 and July 1, 2014. You might still be finding ones you haven't seen.
That's the case for the SLAPP Defendants.
Yesterday, GA found what may have precipitated the widely publicized "alleged" anti-Semitic posts authored by Lane Bajardi's admitted screen names WakeUp07030 and Mark Lower.
At 9:30 PM on Tuesday, April 28, 2009 Sara Stojovic emailed Hoboken411; Hoboken411 forwards the Stojkovic email to Lane "Red Haven" Bajardi with the message: "Please let's comment!"
At 12:07 AM on April 30, 2009, Lane Bajardi's admitted screen name, WakeUp07030 posted this on the Hoboken forum at nj.com:
At 5:00 PM on August 12, 2009, another one of Lane Bajardi's admitted screen names, MarkLower posted this on the Hoboken forum at nj.com:
GA recalls seeing many similar comments, directed at the mayor's husband. The above were saved by Mr. Grossbard and authenticated by him in a certification provided to Defendants.
Like Mr. Grossbard, GA's non-actionable opinion (yours may differ) of these comments is that they are anti-Semitic and highly offensive personally. As stated in my Sur Reply to my Motion for Summary Judgment filed on September 2, 2014:
“WakeUp07030” [Mr. Bajardi] was a prolific nj.com commenter who posted virulently anti-Semitic slurs about the mayor’s Jewish husband, Stan Grossbard, a NYC diamond dealer. “WakeUp07030” [Mr. Bajardi] attacked Mr. Grossbard as a “blood diamonds” merchant with the Mayor enjoying the spoils of her husband’s “blood diamonds” trade. ...Plaintiff Lane Bajardi proves that behind a Screen Name he will use rabid, anti-Semitic rhetoric to attack his political enemies, as he did under the Screen Name, prosbus.(Note, Anthony Petrosino, a Bajardi trial witness in Bajardi v Pincus, certified he exclusively used the screen name 'prosbus.')
On February 23, 2015 the Hudson County View filed a report on Mr. Grossbard's opinion of the WakeUp07030 and Mark Lower postings he had archived. Neither the article, nor any facts presented within, have been disputed by Jonathan Z. Cohen, Mr. Bajardi's attorney.
In part, it reads:
While Mr. Bajardi's attorney, Mr. Cohen, has never disputed that his client was the author of both highly offensive comments directed at Mayor Zimmer's Jewish husband, Mr. Grossbard and his business, the above email exhibit provides a context for the offensive postings of Lane Bajardi's admitted screen names, "WakeUp07030" and "Mark Lower."
