Lane Bajardi: "Beth is Delusional... "

 Filing a SLAPP suit may cause a debilitating sense of dread

Do you think building a minor league baseball stadium in Hoboken is a good idea?

In July 2009, Councilwoman Beth Mason did.  In fact, she hired an architect to design a proposal for the northwest corner of the city, and told media she was determined to get Yankees, Mets, or Red Sox minor league team to Hoboken.

The merits of this plan is discussed in an email exchange between Hoboken411 political ghostwriter Lane Bajardi and Hoboken411.

Nothing has changed in the Land of Spin, otherwise known as the space between Beth Mason's ears.

The Mason brain(less) trust is pushing the narrative that Mason isn't running for 2nd Ward City Council because she is destined for bigger things in Washington (D.C. not Seattle.)

GA hopes its true.  In the meantime, her busy worker bees have pollinated Sully's column...

 ...and posted 'evidence' on Facebook: an actual photo of Councilwoman Mason with Hillary Clinton!   

The public domain Bajardi emails have taught us how the Mason machinery works.  Look under the hood.  You'll find lawyers and political operatives feverishly cranking out one campaign after another, bada bing bada bang, to advance Beth Mason's political career.  Spin, spin, spin.

The rollout of  "Hillary & Me" is more of the same; the inherent dishonesty of this one is no different than any other. 

 Today Horsey is reporting the rumor that Beth Mason has dropped $200K into Hillary's campaign war-chest.  That would explain the photo; everyone knows politicians pose with donors for a price.

This one reportedly cost $30,000.

Say "Cheese!" and hand over the cheddar.

That's they way it works, people.  About this photo...

GA noticed the odd cropping.  Pop it in a standard 4" x 6" frame (below)... see all the space that got cut out (allegedly)?

That's a lot of dead space!  What a waste.

GA will suggest 4 options to restore the photo to it's (allegedly) original size.

Due to scale and proportional issues, Hillary's face was blocked.  Perhaps Beth Mason might file smaller complaints in the future?



The SLAPP Suit Option is another possibility.  Downside: it takes 2 1/2 years to create.  That's almost as long as growing asparagus from a seed. Again, apologies to Hillary Clinton for proportion issues. Please  Mrs. Clinton, tell Beth Mason to allegedly underwrite smaller SLAPP suits in the future.



The ELEC Complaints Option works well until Mason gets a 3rd ELEC Complaint, and there goes Hillary. 


Speaking from a graphic artist's perspective, the Nazi Truck option is the best layout.  It fits (2) Nazi Trucks- a daytime and nighttime view, the full Facebook photo, and has room for a Barracato.  That's appropriate, since Noel Torres, the driver of the Nazi Truck, recently claimed he got the swastika-video thumb drive, a $5,000 cash payment and $500 to "keep it quiet" from Barracato.  

Does Hillary Clinton know that James Barracato is Beth Mason's "business partner?" Well., he fits nicely in the photo. Oh look, he's holding the disk he obtained with "60,000 emails" between the Mayor/HMHA and the hospital buyer during the sale!  Wow, quite a bonus.

This layout could be even more space efficient if we put Beth Mason and Hillary Clinton inside the Nazi Truck.

Do you think Hillary would mind?Let's ask her!

Maybe the Nazi Truck can give them a lift back to D.C?

GA ran across another email exchange proving Lane Bajardi knew the identity behind another screen name 2 years before Bajardi tossed him into Paragraph 130 of  Bajardi v Pincus, subjecting the anonymous individual to the financial and mental stress of defending his anonymity in court.

On October 15, 2010 Sara Stojkovic emails Lane Bajardi:

The "Lenz arrest record" Stojkovic refers to is an incident that happened on December 13, 2007.

Plaintiffs' Emails prove that Plaintiffs knew the identities of many screen names

Few of us knew we were targets before we became Defendants.

I'm talking about the John Does and Paragraph 130's.  They were persons whose identities were known to Plaintiffs, but they were thrown into Bajardi v Pincus ANYWAY 


GA believes to subject pro-Reform bloggers to harassment and the astronomical cost of defending their anonymity from whatever came next.

Here is what the Plaintiffs promised for the "unnamed Defendants:" 

Get it?   And the purpose of all this?

The purpose of identifying John Does and Paragraph 130s was to  add them to the SLAPP as "named defendants."

In true SLAPP fashion, the Bajardis knew the identities of some "un-named Defendants."  This is proven by their emails and depositions.

At his deposition, Lane Bajardi admitted to knowing or "having a pretty good idea" of who was behind screen names he threw in the litigation (like SS1959), but emails prove he lied at his deposition about others, such as InfotainMe.

At 10:27 PM on February 8, 2012, Lane Bajardi emails James Barracato his "Attorney Intro Note." Bajardi's "note" includes admissions he knows the true identities of InfotainMe and plywood- who were later thrown into Bajardi v Pincus.

 "davidd" is another Paragraph 130 Defendant whose identity was known by Plaintiffs.

In this example, Sara Stojkovic tries to get the man behind screen name "davidd" booted from POG for his internet postings.

At 11:56 AM on March 13, 2011, POG President Alice Crozier sends an email blast to POG members, titled "candidate's debates." 

At 2:05 PM, Sara Stojkovic forwards the mail to another POG member, Bob, with the message:
 Why is David (redacted) included on this list? He doesn't live in Hoboken and he's one of the Zimmer people bashing POG on Roman and Kurt's site...and Patch! He uses his own name. Why does POG feel beholden to provide him with any communication?
Bob continues the exchange with Crozier.

At 8:04 PM, Stojkovic emails Crozier a davidd post, "one of many, many..."

At 7:44 AM  on March 14, 2011, Crozier replies to Stojkovic:
"I am not up on Hoboken blogs, so the fact that I have not seen (redacted) there means nothing.
I can tell you how POG works though. When someone pays the annual dues he or she is a member until the next time dues are due, the following fall. The treasurer keeps a list of who is paid up. Where they go after that is not up to us..."
 At 8:59 AM Stojkovic forwards her exchange with Crozier about davidd to Kim Cardinal.

At 9:08 AM Kim Cardinal  refers to davidd by surname and adds "He lives in France but is blogging about Hoboken..."

Kim Cardinal knew davidd's identity 17 months before she threw him in HER complaint as a Paragraph 130 defendant. 

Stojkovic appeared to be ticked off by Crozier's expressed indifference to ddavid's postings and place of residence.

At 9:26 AM Stojkovic vents to Crozier alleging "offensive and destructive" online comments made by "Zimmer supporters."

At  9:29 AM Stojkovic forwards the email to Kim Cardinal.

At 9:03 AM Alice Crozier emails Sara Stojkovic, in an exchange which GA believes will become a classic.  

Crozier begins the exchange: "By the way, Lane is a member in good standing."

These are not the only screen names whose identities Plaintiffs' knew before they threw them in Bajardi v Pincus.

It's in the emails.

Lane Bajardi: "as discussed... proposed resolution is attached" (ANOTHER!)

Only 8 days after Lane Bajardi sent his Muni Garage resolution to Tim Occhipinti, Theresa Castellano and David Cruz, the Schmaltz-King of Hoboken was at it again.

Yes, Lane Bajardi wrote (more) legislation for the City of Hoboken, then like before, trafficked it to anti-Zimmer officials on the Hoboken City Council.  Moreover, this time Mr. Bajardi clearly layed out the political and strategic purpose of his resolution:
"...(the) proposed resolution for New Business is attached as a means to aggressively fight the misrepresentation of your record on development and move the First Ward forward."
At 1:00PM on Wednesday, March 16, 2011 Lane "not an operative" Bajardi emailed 1st Ward Councilwoman Theresa Castellano, Anthony Pasquale and David Cruz an attachment, "MuniGarageReexamintionResolution.doc."

Bajardi's detailed instructions to Castellano began:  
"I'm not trying to put words in your mouth... " 
then he proceeded to put words in her mouth.  Bajardi "suggested" Castellano introduce his attached resolution to Hoboken's City Council , "suggesting" more detailed instructions about what the Councilwoman should do before, during and after Bajardi's Resolution is introduced.  Lane Bajardi instructed the Councilwoman:
 "A press release with the resolutions attached (including the resolution to stop the Impound Yard) should then be sent out on Thursday morning." 
 Oh. no... he's not a political operative.

At 3:28 PM, Lane Bajardi forwards the email and attached Bajardi resolution to Terry's son,  John Castellano.

"Troops" No More?

My friend Al Sullivan had this tasty dish in this week's column:
Fourth Ward Councilman Tim Occhipinti has made it clear that he is not going to be run out of town, despite a likely challenge from former Assemblyman/Councilman Ruben Ramos...   Rumors suggest that Ramos is so determined to get even with Occhipinti for the 2013 loss that he might even be willing to make a deal with Zimmer, and apparently wants to settle scores with other anti-Zimmer people, such as Councilwoman Terry Castellano. Ramos is rumored to be seeking a candidate to run against Castellano as well.
GA wasn't aware Ruben was miffed at Terry Castellano.  For what?  Did she fly too low over him? 

Ruben honey, solve your problem with a bucket of water.

GA is not sure what to think about the alleged animus between Ruben Ramos and Tim Occhipinti, who only a few short years ago were "troops" on the same side of Hoboken's factional warfare.

GA didn't call them "troops," one of the "troops" called them "troops:"  

That's quite an army!

The dedication of this army to triumph on the political battlefield, in lockstep, with a unified strategy developed off the battlefield, is clear.  What is not clear is who this leading this army.  Maybe that's why they keep losing?  Or are they losers because they have followed the wrong leader? Or are they losers because some have betrayed others- like snatching defeat from the jaws of victory in a mayoral race?

Who knows.

In any case, these "troops" seem to conduct civil discourse amongst themselves, always polite. As in the "combat" strategy offered  Lane "not an operative" Bajardi
"...We need to spread the word as best we can and prepare for a showdown at the first meeting of the new year. The other side is loaded for bear. We need to be prepared to combat their planned show of force."
This civility of the 2010 army makes it hard to believe the 2015 army has split into the factions described by Al Sullivan.

GA has no horse in a Ruben v Tim race, but peeps tell me Assemblyman Ramos was an excellent, proactive advocate for public school education in Trenton.   GA hopes, should he run, he maintains his commitment to everybody's children, including the disadvantaged and expensive-to-educate.

At the end of the day, that is what matters.

Why did HoLa Trustee remain silent he was "CuriousGal" and "prosbus"?

Many questions surround the involvement of Anthony Petrosino, HoLa Trustee and Advisory Board member, in the Bajardi-Cardinal defamation SLAPP suit.

If you don't know, Mr. Petrosino provided a certification for Plaintiffs Lane Bajardi and Kim Cardinal on September 19, 2014.

On or about February 6, 2014, Petrosino flew in from Austin, Texas to appear as a trial witness for   Lane Bajardi in Hudson County Superior Court.

You see, under oath Petrosino certified he had "exclusive use of usernames and passwords for "CuriousGal" and "prosbus."  

Note, a central allegation of the Bajardi lawsuit was that they were not posting as "Curious Gal" and "prosbus."   In 2011 and 2012, there were hundreds of comments by both screen names posted on Hoboken Patch; I filed the entire collection in my Motion for Summary Judgment as Exhibits KK and LL (see below).

If we believe Petrosino's certification (and why would he lie under oath?), then the Curious Gal and prosbus posts written by him are a reasonable basis to believe he is a partisan political operative with a rabidly anti-Zimmer, anti-Kids First agenda.

Why does it matter?

Because Petrosino sits on a charter school board which handles the expenditure of public money, which makes it a matter of public interest and public concern. Read the "prosbus" and "Curious Gal" comments below, and see how you feel about his judgment as a steward of your money.  

The most basic question raised by Petrosino's certification is: why didn't he ever come forward to correct the alleged mis-identification of the Bajardis as prosbus (Lane) and CuriousGal (Kim)?  Petrosino had literally hundreds of opportunities to do so during his constant online presence on Patch.  Yet he never did.   Not once in 2011 nor 2012. 

On March 2, 2012 Sara Stojkovic emails Kim Cardinal:
"I don't think they believe for a minute that Lane has left politics... They assume the two people, probus and curiousgal, are Lane and you and unfortunately, those two bloggers have not denied it. Those two bloggers feel their anonymity is safe because the zealots think they are communicating with you and Lane everyday. By leading the zealots on, the zealots are even more sure that those two bloggers (or one) are you and Lane."
 "Leading on" is one way to put it. I'd use the word "baiting."

Curious, no?  Why did Anthony Petrosino continue provoking or "leading on" others to think prosbus and CuriousGal were the Bajardis over many months?

Further, Petrosino's postings seemed deliberately constructed to elicit a fiery response from particular Zimmer allies, many of whom ended up as Defendants in Bajardi v Pincus .  Many of his most vicious postings were directed at me, and I ended up being 60% of Bajardi v Pincus .

As all the baiting and barking was going on in threads hundreds of posts long, Petrosino never stepped up with a post to 'help' the Bajardis and stop the alleged defamation.  He could have done it while protecting his anonymity.  He could have done it through a third party.

But he did fly in from Austin to testify for them.... does it make sense?

Lane Bajardi: "Here's my draft resolution..." UPDATED

Yesterday's post was a soup-to-nuts narrative of how one political operative: (1)  wrote a city council resolution for 1st Ward Councilwoman Theresa Castellano and 4th Ward Councilman Tim Occhipinti, (2) lobbied for his resolution in ghostwritten article  "Opposition to Impound Lot Grows"published on Hoboken411, and (3) lobbied  under admitted screen names "4th Ward Guardian" and "Mark on Park," (created specifically for the Tow Yard thread).  

One ingredient was missing.

This alleged "opposition"was more smoke and mirrors blown from the same source. Here is what the  Hoboken411 ghostwriter (Lane Bajardi) published on Hoboken 411 regarding the ghostwritten Bajardi Resolution about a "community education campaign underway..."

Can you guess?  The "community education campaign" fliers distributed in the ghostwriter's neighborhood were written by....

The same "flier" referred to by "Mark on Park" (GA added comments in blue).

Talk about a one-man political-operative band: writer, director, producer and audience. 

GA would love the video of "Mark on Park" lobbying for the Bajardi Resolution at the May 4, 2011 city Council meeting, if anyone out there wants to cut it. *hint hint*

Meanwhile, at 9:23 PM on May 4, 2011, Mrs. "Mark on Park," Kim Cardinal, who was apparently watching the City Council meeting from home, sent this email to political operative James Barracato:

GA was shocked at this one.

You will see that this operative also writes legislation for Hoboken's governing body to vote on.  Oh, yes.

City Council President Beth Mason placed Lane Bajardi's draft resolution on the Consent Agenda for the March 16, 2011 City Council Meeting. 

Lane Bajardi's ghostwritten resolution was sponsored by Councilwoman Theresa Castellano and Councilman Tim Occhipinti.

Here is the actual resolution submitted to the Mayor, City Council and professionals, in the March 16, 2011 Resolution package:

The March 16, 2011 meeting minutes show no action taken on the Bajardi Resolution. 

The Bajardi Resolution was carried over to the April 6, 2011 meeting, and then to the May 4th meeting.

At 1:37 PM on May 1, 2011, Lane Bajardi emails Hoboken411, "This is the week we really rock their world... this is the week that widens the gap of the "close" races..."    Bajardi is referring to the municipal election scheduled on May 10.  He adds, "I'm also working on a story about... using the Muni Garage as a 24/7 Tow Yard, " referring to the subject of the Bajardi Resolution.

At 1:46 AM May 3, 2011, Lane Bajardi emails Hoboken411 his ghostwritten  "Opposition grows to Impound Lot proposal.doc " for publication.

In his ghostwritten article, he includes his ghostwritten resolution.

At 10:10 AM on May 3, 2011 Lane Bajardi emails Hoboken411:
"As I figured, the anti-Lane and Perry people (HoneyDew, and there will be more) are looking to cause trouble on the tow yard site. My guess is HoneyDew is one of our major enemies hiding in plain view.

If 4th Ward Guardian starts taking the lead role on this thread that name will be useless because it will become obvious it's me. xyzpdq is a non-political poster who generally doesn't weigh in much on politics and has always led people to believe he/she lives "in the center of town" either in the 3rd or 6th.

Can I get a screen name just for this thread? Does a thread-specific name like "StopTheTowYard" make sense? This screen name would only be for the Tow Yard, and once that story goes away would not return."

Note,"4th Ward Guardian" and "xyzpdq" are two of Lane Bajardi's admitted screen names.

The Bajardi Resolution was revised with 3 new paragraphs; 7 original paragraphs were kept and 6 original paragraphs were omitted.  Bajardi's title was shortened to: "Resolution Rejecting the Proposed Use of the Municipal Garage Site as a 24/7 Impound Lot."

At  1:09 AM on May 5, 2011,Lane Bajardi sends his ghostwritten "Tow Yard UPDATE.doc" to Hoboken411 for publication.
